Maricopa County’s initiative to improve air quality has reached a significant milestone with the U.S. Environmental Protection Agency’s (EPA) final approval of Rule 205, which aims to reduce emissions while promoting economic growth.
Details of Rule 205
Rule 205, adopted in May 2025, allows fleet owners and operators to earn emission reduction credits (ERCs) by upgrading or replacing high-emitting on-road vehicles with cleaner alternatives. These credits can help offset emissions from new or expanding industrial sources, assisting businesses in complying with the Clean Air Act’s nonattainment New Source Review program. With this final approval, Maricopa County is set to implement the rule immediately, enabling the issuance of ERCs to businesses.
She emphasized the approach of incentivizing rather than penalizing businesses, which is expected to lead to tangible improvements in air quality alongside new investment opportunities.
Support from Local Leaders
Vice Chair Debbie Lesko praised EPA Administrator Lee Zeldin for collaborating with Maricopa County to develop solutions tailored to the region’s needs. She highlighted the importance of this partnership in streamlining regulations while ensuring air quality protection.
The approval of Rule 205 follows closely on the heels of the EPA’s proposed approval of Rule 204, which incentivizes the upgrade or replacement of high-emitting non-road vehicles, including construction equipment and railroad locomotives. Together, these rules represent groundbreaking measures in the country and aim to position Maricopa County as a leader in innovative government practices.
Impact on Air Quality and Economy
The combined initiatives are designed to provide both regulators and the business community with new strategies to meet federal air quality standards while fostering economic development. This dual focus underscores Maricopa County’s commitment to improving environmental conditions in a way that supports local businesses and job creation.
